If you look at the very low<\/span> market cap<\/strong> of Rusoro Mining (TSXV: RML)<\/strong> relative to the very high<\/span> odds<\/strong> that they will collect on their US$1.76 billion <\/strong><\/span>judgment<\/strong> against<\/strong><\/span> Venezuela<\/strong> through either the upcoming auction<\/strong><\/span> of Citgo<\/strong><\/span> or a settlement<\/strong><\/span> beforehand… RML<\/strong> is going A LOT higher<\/strong><\/span>.<\/span><\/span><\/p>\n\n

Citgo<\/strong><\/span> is sitting on US$3.9 billion<\/strong><\/span> in total liquidity (mostly unrestricted cash in a U.S. bank account) to negotiate initial settlement payments<\/strong><\/span>. Earlier this month, U.S. oil and gas producer ConocoPhillips<\/strong> said it sees “light at the end of the tunnel”<\/strong> for resolving<\/strong><\/span> its US$1.3 billion<\/strong><\/span> judgment<\/strong> that it is seeking to collect<\/strong><\/span> through an auction<\/strong><\/span> of Citgo<\/strong><\/span>.<\/span><\/span><\/p>\n\n

ConocoPhillips<\/strong> CEO Ryan Lance<\/strong> said, “Yes, we’re right in the middle of all those conversations, as you might imagine, including the most recent conversations around the CITGO refining assets. We’re in the queue, we’re in the — right in the middle of anything that would happen there. We have — as a reminder, an ICC judgment of $2 billion. We’ve collected about $700 million on that judgment to date. So we have an outstanding — what they owe us on that particular judgment.”<\/strong><\/span><\/span><\/p>\n\n

This means settlement talks might already be ongoing<\/strong><\/span> today between Venezuela’s PDVSA<\/strong> and creditors Rusoro Mining (TSXV: RML)<\/strong>, ConocoPhillips<\/strong>, Crystallex<\/strong> (now owned by Tenor Capital), Gold Reserve<\/strong>, Gruma SAB de CV<\/strong>, OI European Group BV<\/strong>, Koch Minerals<\/strong>, Huntington Ingalls<\/strong>, ACL1 Investments<\/strong>, Maritime Support Co<\/strong>, and PdV 2020 Bond Holders<\/strong>.<\/span><\/span><\/p>\n\n

An auction<\/strong><\/span> of shares in PDV Holding<\/strong>, whose only asset is U.S. refiner Citgo Petroleum<\/span><\/strong>, to pay claims<\/strong><\/span> could be scheduled<\/strong><\/span> by September 5<\/strong>.<\/span><\/span><\/p>\n\n

Crystallex filed<\/span><\/strong> a motion<\/strong> yesterday attempting to stop<\/span> Venezuela’s appeal<\/strong> to the March 24th decision that RML<\/strong> can collect<\/strong><\/span> from the Citgo<\/span> auction<\/span> proceeds<\/span><\/strong>. Crystallex<\/strong> believes that because Venezuela lost<\/span><\/strong> its appeal<\/strong> against them, they shouldn’t<\/strong><\/span> be allowed to appeal<\/strong> the March 24th ruling that Rusoro Mining (TSXV: RML)<\/strong> can collect<\/strong><\/span> from the Citgo<\/span> auction<\/span> proceeds<\/span><\/strong>. This legal matter<\/strong> was already decided on<\/strong><\/span> by the same Third Circuit Court <\/strong>and Venezuela lost<\/span><\/strong>! Crystallex<\/strong> believes the auction<\/strong><\/span> of Citgo<\/strong><\/span> should be scheduled immediately<\/strong><\/span>!<\/span><\/span><\/p>\n\n
